1. Artificial Intelligence FAQs

1.1 Does Shade use my data to train artificial intelligence (“AI”) models?

All customers are by default opted out of AI model training. Shade will not use customer data for AI model training without consent.

Shade may provide opportunities for your workspace administrators to opt-in to the use of customer data for AI model training. Opting-in to this training helps to improve our models and, as a result, provide better services to you. Prior to using customer data for training, Shade undertakes a sanitization process designed to remove common sources of personal data.

1.2 Where are your services hosted?

All of our services are hosted in the United States. We only train and host our models in the United States.

1.3 How do you remove bias from your AI?

Shade employs a multi-layered approach designed to identify, mitigate, and monitor bias in our AI systems, particularly in our natural language search. Our bias mitigation strategy aligns with industry standard practices and established fairness standards, such as the NIST AI Risk Management Framework and ISO/IEC 23053 guidance on bias in AI systems. We implement rigorous dataset auditing processes designed to ensure our training data represents diverse demographics, creative styles, and cultural contexts, and take steps designed to address identified underrepresentation. Our evaluation framework includes both automated bias detection tools and human review processes conducted by our AI team. Performance metrics are regularly assessed against established benchmarks such as those recommended by the Partnership on AI and IEEE Standards for Algorithmic Accountability.

2. Biometric Data FAQs

2.1 What should I know about biometric laws?

Biometric laws are privacy law focused on the handling of Biometric Data (as defined in the Biometric Data Addendum), such as a face vector, and certain related information. They may apply if a service you are using involves Biometric Data. Many biometrics laws have specific requirements for providing notice to and obtaining consent from individuals who the Biometric Data relates to and complying with deletion requests. Shade’s customers are responsible for understanding and complying with their obligations under biometric laws, including by providing required notices and obtaining required consents. If you provide notice and obtain consent, you should do so on behalf of any relevant service providers, including Shade (identified as your service provider). Please see our Biometric Data Addendum for more information about our biometric service features. You can find a sample of notice and consent language below.

2.2 Does Shade have sample language for proving notice and consent on behalf of service providers?

Yes. Below is sample language for providing notice and consent on behalf of service providers (such as Shade) in connection with Biometric Data (as defined in the Biometric Data Addendum, available at Biometric Data Addendum. You are responsible for making your own assessment of whether your use of Shade’s Services (as defined in the customer agreement between you and Shade (“Agreement”)) meets applicable legal requirements. Please note that this sample language is not legal advice and Shade makes no representations, warranties, or covenants as to the appropriateness, sufficiency or accuracy of this sample language, nor that this sample language will comply with all applicable laws, including but not limited to Biometric Data Laws (as defined in the Biometric Data Addendum).

[Your company name] (“Company”) uses one or more service provider(s) for identifying individuals in photos and videos. Biometric identifiers and biometric information, which include “face vectors and other facial attributes” (collectively, “Biometric Data”), may be collected, stored, and used by Company’s service provider(s) on behalf of Company for the purpose of providing the service. Company will instruct its service provider(s) to permanently destroy Biometric Data that is stored on Company’s behalf when the initial purpose for collecting or obtaining such data has been satisfied, when you request that the data be deleted, or earlier, if required by law. Biometric Data may be transmitted between Company and its service provider(s) to provide and receive this service. By agreeing to this consent, you hereby agree to allow Company and its service provider(s) to collect, use, and store your biometric data as described above.

2.3 How long does Shade retain Biometric Data?

You are responsible for determining how long Biometric Data is retained by Shade and for complying with any limitations on such retention of Biometric Data under applicable law. Your workspace administrator can delete Biometric Data by deleting individuals from the individuals page or deleting all data by deleting your workspace.
